The purpose of the present study is to address the questions pertaining to the competence of Community institutions in matters concerning churches and religions, with the aim of determining whether the traditional relations of individual countries with religious denominations and religions may be subject to modifications introduced by Community institutions. In other words, the study aims to explain whether Community institutions are entitled to make attempts to introduce top-down unification of the models of relationships holding between individual member states and religious denominations that exist in their territory. In order to answer these questions, it is necessary to conduct an analysis of current Community law. Moreover, the discussion will take into consideration the resolutions of the Treaty establishing a Constitution for Europe (although it was rejected by some European countries) and the Treaty of Lisbon (whose has not received ratifications of all member states yet).
