Abstract
Recently, courts and legislatures in the U.S. have begun to grapple with the important questions the sharing economy brings to labour law, particularly regarding gig workers status as employees or independent contractors. What follows is an analysis of some recent, key judicial decisions, legislative action and academic literature on the subject. Specifically, the essay deepens both the theme of a simplified test for employee status, resulting in most gig workers becoming employees, and the possibility the collective bargaining rights be granted for gig workers – irrespective of their independent contractor status – to enable them to negotiate adequate protections in the new platform economy.
