Abstract
Asmens teisė į privatumą žinoma gana seniai. Tačiau tol, kol ji tapo visuotinai pripažinta ir saugoma vertybe, praėjo nemažai laiko. Dabar ši teisė saugoma daugelyje regioninių ir tarptautinių sutarčių – 1948 m. Jungtinių Tautų Visuotinės žmogaus teisių deklaracijos 12 straipsnyje, 1950 m. Europos Žmogaus teisių Konvencijos 8 straipsnyje. Lietuvoje asmens privataus gyvenimo neliečiamumą saugo aukščiausią teisinę galią turintis dokumentas –Konstitucija. Tai rodo ypatingą šios teisės reikšmę. Šie šaltiniai asmens teisę į privatumą įtvirtina kaip fundamentalią žmogaus teisę. Tačiau vieningos privataus gyvenimo sampratos nėra. Įvairiuose nacionaliniuose ir ypač tarptautiniuose teisės aktuose ši teisė apibrėžiama gan abstrakčiai ir lakoniškai, paliekant jos turinį išplėtoti teismų praktikai. Tačiau Europos Žmogaus Teisių Teismas pasisakė nemanąs, kad būtina pateikti ar kitaip apibrėžti privataus gyvenimo neliečiamumo sąvokos. Bendriausia prasme privatumą galima apibrėžti kaip žmogaus teisę būti paliktam vienam. Žmogus turi teisę pats spręsti, kokią informaciją jis nori apie save skleisti, o kokia informacija yra išimtinai tik jo reikalas. Tačiau kaip ir kiekviena teisė, asmens teisė į privatumą nėra absoliuti. Tam tikrais atvejais yra galimybių ją riboti ar kitaip varžyti. Santuokos nutraukimo dėl sutuoktinio kaltės bylose, lemiamą reikšmę turi įrodymai. Būtent įrodymai lemia tai, ar santuoka bus nutraukta remiantis sutuoktinio kalte, ar kitais pagrindais. Tokių bylu specifika – kaltės buvimą pagrindžiančius įrodymus turi pateikti suinteresuotoji pusė. Todėl sutuoktinis, norintis įrodyti kito sutuoktinio neištikimybę, neištikimybės buvimą turi įrodyti pats. Kitas būdas – pasinaudoti privačių detektyvų teikiamomis paslaugomis. Šiame darbe nagrinėjama dviejų įstatymų saugomų vertybių – santuokos ir privataus gyvenimo neliečiamumo sandūra. Kadangi sutuoktinius sieja itin artimas bei glaudus ryšys, nepalyginamai artimesnis už kitų asmenų santykiuose vyraujantį ryšį, nėra aišku, kokie privatumo standartai galioja santuokoje. Prasidėjus pasaulį iš pagrindų keičiančiai technikos invazijai, privatumas santuokoje tapo dar trapesnis. Technikos tobulėjimas sudarė didesnes galimybes sutuoktiniams tikrinti vienas kitą, kartais nekreipiant dėmesio į tai, kad kitas sutuoktinis turi teisę į privataus gyvenimo apsaugą. Galimų sutuoktinių privatumo pažeidimų kiekis ir per mažas į šiuos pažeidimus kreipiamas dėmesys rodo tiriamos problemos aktualumą.
Person‘s right to privacy is known quite a long time. But as long as it has become generally accepted and preserved value , it took some time. Now, this right is protected in many regional and international treaties – 1948 United Nations Universal Declaration of Human Rights, article 12, and in 1950 European Human Rights Convention, article 8. The highest legal document – the Constitution- protects personal privacy in Lithuania. This reflects the special importance of this legislation. These sources set the individual‘s right to privacy as a fundamental human right. However, a unified concept of privacy does not exist. Various national and especially international laws define this right rather in the abstract and laconically, leaving its contents for the development of case law. However, the European Court of Human Rights spoke that it is unnecessary to provide or othervise define the concepts of privacy. In the most general sense the privacy can be defined as the person‘s right to remain alone. Man has the right to decide what information he wants to spread about himself and what information is entirely his matter. The concept of private life is usually associated with the evaluative criteria, because everyone has a different perception of privacy. But like any law, a person‘s right to privacy is not absolute. In some cases there are possibilities to limit it or otherwise to restrict it. Evidence is crucial in the cases of termination of marriage relating to the spouse‘s fault. Namely the evidence determines whether the marriage will be terminated in accordance with the spouse‘s fault, or other reasons. Specifics of such cases – the evidence supporting the existence of the fault must be provided by an interested party. Therefore, the spouse who wants to prove the other spouse‘s adultery must prove the existence of adultery by himself/herself. Another way is the use of private detective services. This master thesis analyzes the interface of two values protected by law – the marriage and the privacy. Since the spouses have very close relationship, much closer than the relationships prevailing in other persons, it is not clear what privacy standards apply in marriage. After the beginning of the world substantially modifying technical invasion, the privacy in marriage has become more fragile. Technical development permitted the spouses to check each other, sometimes ignoring the fact that the other spouse may have the right to privacy. The amount of potential violations of spouse‘s privacy and too little attention to these violations shows the relevance of this problem.
