dc.description.abstractPirmoje darbo dalyje aptariama turto realizavimo vykdymo procese samprata ir teisiniai institutai garantuojantys teisėtumą vykdant turto realizavimą. Vykdymo procese skolininko turtas realizuojamas priverstinai LR CPK nustatytais turto realizavimo būdais. Institucijos, kurios privalo garantuoti teisėtumą vykdant priverstinį turto realizavimą yra teismas ir antstolis. Antroje dalyje analizuojami turto realizavimo vykdymo procese būdai, jų vykdymo ypatumai. Šie būdai yra penki: 1. Turto pardavimas iš varžytynių; 2.Turto pardavimas per prekybos įmonę; 3. Turto perdavimas išieškotojui; 4. Pardavimas skolininko pasiūlytam pirkėjui; 5. Vertybinių popierių pardavimas biržoje. Trečioje dalyje, apžvelgus turto realizavimo samprata, teisėtumą garantuojančius institutus ir turto realizavimo būdus siekiama atskleisti turto realizavimo būdų taikymo ypatumus, analizuojami turto realizavimo būdų taikymo privalumai ir trūkumai, taip pat pažeistų vykdymo proceso šalių teisių
dc.description.abstractThe paper begins with introductory part. The main aims of the paper are stated in the three parts of the analysis. In the first part the most attention is given to describe the conception of property realization in the performance process, also the most important legal institutes that guarantee legitimacy of property implementation are excluded. Implementation of property is a compulsory under arrest property’s belonging to debtor or pledger by ownership sale by auction competitive bidding, through the companies that deal with sale of property or recycling, transference to bailiff or realization in the other order. The bailiff and the court guarantee legitimacy of property of compulsory realization. That are and the institutions, that implement compulsory realization of property as well. They have been given all the rights for these actions by the lawmaker. To use these rights one needs to be very responsible, because realization of the property is being implemented in the performance process. In the second part of the paper ways of property realization in the performance process are discussed. The main ways of property compulsory realization are: property sale by auction competitive bidding, property sale through the trade company, property transference to bailiff, debtor’s right to suggest the buyer himself, securities issues stocks sale in stock exchange. Property sale by auction competitive bidding is discussed in more details, because it is one of the most often applied ways of compulsory property realization, questions of assessment of property, provisions of taking part in auction competitive bidding, advertisement about coming auction competitive bidding, the order how to conduct the auction competitive bidding, protocol of auction competitive bidding and act of property sale by auction competitive bidding, announcement of auction competitive bidding as non-accomplished, second auction competitive bidding are discussed. Finally in the third part peculiarities of appliance ways of property realization and advantages, and disadvantages are analysed. Parties’ assertion for offending against the process as well. In fact principle of law balance between the parties must be kept by all parties taking part in property realization that is the parties, bailiff, third persons. The court can revive infringed rights of parties the most effectively; it has all power of attorney for this.en
