Abstract
Gyvenimo kartu, neįregistravus santuokos forma, atsiradusi šalia tradicinio santuokos instituto, Vakarų šalyse lėmė naujo, bendro gyvenimo neįregistravus santuokos (angl. cohabitation) ir registruotos partnerystės (angl. civil partnership) institutų atsiradimą. Šiame baigiamajame darbe analizuojama teismų praktika, užsienio ir Lietuvos mokslininkų darbai bei teisės aktai, siekiant rasti atsakymą į pagrindinį klausimą: ar užsienyje teisėtai sudaryta registruota partnerystė gali būti pripažįstama Lietuvoje. Pažymėtina, kad registruotos partnerystės institutas labiausiai reikalingas tos pačios lyties asmenims, siekiantiems įteisinti santykius ir skirtingų lyčių asmenims, kaip alternatyva santuokai, išeitimi skirtingų lyčių asmenims, nenorintiems sudaryti santuokos, tačiau laikantiems save šeima ir norintiems įteisintini savo santykius. Analizuojant baigiamojo darbo problematiką, pastebėtina, kad vis dar neveikiantis partnerystės institutas Lietuvoje, nesuteikia realios galimybės užsienyje teisėtai partnerystę įregistravusiems asmenims teisėtai gyventi Lietuvoje. Kitoje šalyje teisėtai sudarytos registruotos partnerystės nepripažinimas Lietuvoje riboja laisvo asmenų judėjimo ir pasirinkimo laisves. Todėl pagrindinis darbe išsikeltas tikslas - atlikus teorinę ir praktinę užsienyje teisėtai registruotos partnerystės analizę, nustatyti ar Lietuvoje tokia partnerystė turėtų būti registruojama ar vis gi ne. Pagal darbo tikslą išskiriami penki uždaviniai, kuriuos įgyvendinus, išsiaiškinamas pagrindinis klausimas ir apginama darbe išsikelta hipotezė, kad: užsienyje teisėtai sudaryta registruota partnerystė nepripažįstama Lietuvoje, tačiau į Lietuvą atvykusiems partneriams privalo būti sudarytos sąlygos tinkamai integruotis visuomenėje. Darbas baigiamas išvadomis, priimtomis nuosekliai ir smulkiai išanalizavus ne tik Lietuvos, bet ir Europos Sąjungos bei Jungtinių Amerikos Valstijų praktiką pagrindinio baigiamojo darbo klausimo tematika.
Living together in a consensual union form, arising near the traditional institution of marriage, in Western countries it has led to new, cohabitation and registered partnerships (or Civil partnership) institutes emergence. This thesis analyzes the case law, foreign and Lithuanian scientists work and legislation in order to find an answer to the main question: whether abroad a legally registered partnership can be recognized in Lithuania. It is noted that the registered partnership institution most in need of the same sex who wish to formalize relations and different sexes, as an alternative to marriage, outcomes of different sexes who do not want to marry, but keeping yourself a family and want to legalize their relationship. The analysis of the final work problems, noted that the failure of the partnership Institute of Lithuania, prevents abroad legally registered partner properly integrate into society. Furthermore, limited freedom of movement and freedom of choice. Therefore, the main work of its goals - the results of the theoretical and practical abroad legally registered partnerships analysis to determine whether Lithuania such a partnership should be recorded or still do not. By working specifically identified five asked, after which the clarification of the main question and defended the work hypothesis that: abroad legally a registered partnership is not recognized as Lithuania, but Lithuania arrivals partners must be able to properly integrate into society. Working on final conclusions, adopted a consistent and detailed analysis not only in Lithuania, but also the European Union and United States law, on the basic question of the thesis topic.
