Abstract
Darbe analizuojami Lietuvos Respublikos valstybinių socialinio draudimo senatvės ir netekto darbingumo (invalidumo) pensijų kompensavimo įstatymo paskirtis ir taikymas. Atkreiptinas dėmesys, jog atlikus įstatymų, reglamentuojančių kompensacijos tvarką, apžvalgą, išaiškėja, kad jame nėra įtvirtinta galimybė paveldėti mirusiam pensininkui priklausančią pensijų kompensaciją. Šiuo įstatymu yra grąžinamos pensijos tik tiems asmenims, kurie išgyveno iki šio įstatymo įsigaliojimo. Susidariusi situacija reikalauja išsamios tam tikrų teisinių dokumentų, reglamentų, aktų analizės, dėl paveldėtojų teisių kompensuojant pensijas išaiškinimo ir pagrindimo. Nagrinėjant paveldėjimo problemą pensijų kompensavimo įstatyme dėmesys skiriamas tiek teorinei, tiek praktinei problemos pusei, todėl siekiant sėkmingesnio teisinio svarstymo, darbe buvo analizuotas pensinio aprūpinimo teisinis reguliavimas, jo veikimas ir apsauga. Siekiant nustatyti, ar į Lietuvos Respublikos valstybinių socialinio draudimo senatvės ir netekto darbingumo (invalidumo) pensijų kompensavimo įstatymą turėjo būti įtraukti ir mirusiųjų pensininkų paveldėtojai, darbe buvo analizuota, ar asmens teisė gauti pensiją yra jo teisė į nuosavybę, ar mirusiųjų pensininkų paveldėtojams paveldėjimo teise pereina mirusiųjų pensininkų turtinės teisės į pensijų kompensacijas. Ar tai, kad jie nėra minimi įstatyme, įstatymų leidėjas pažeidžia lygiateisiškumo principą ir neužtikrina teisėtų lūkesčių apsaugos principo. Lietuvos Respublikos Konstitucinio Teismo teisinės doktrinos, Europos Žmogaus Teisių Teismo jurisprudencija parodė, jog asmens teisė gauti pensiją yra asmens teisė į nuosavybę. Taigi asmuo gaunantis pensiją, kaip subjektinių teisių į nuosavybę turėtojas, turi teisę reikalauti, kad kiti nepažeistų jo teisių, o valstybė privalo pateisinti asmens teisėtus lūkesčius ir tuo pačiu užtikrinti šios nuosavybės teisių apsaugą. Atlikus išsamią analizę galima tvirtinti, kad mirusio asmens turtinės teisės, šiuo atveju „Valstybės skola“, pereina jų paveldėtojams. Todėl įstatymų leidėjas, grąžindamas pensijų kompensacijas, turi užtikrinti nuosavybės teisės gynimą ir apsaugą visų asmenų atžvilgiu, kuriems ši nuosavybės teisė priklauso. Norint išspręsti nagrinėjamą problemą siūloma Lietuvos Respublikos valstybinių socialinio draudimo senatvės ir netekto darbingumo (invalidumo) pensijų kompensavimo įstatymą suformuluoti taip, kad šis nepažeistų teisių į nuosavybę, teisėtų lūkesčių, bei lygiateisiškumo principų tiek pačių pensininkų, tiek ir paveldėtojų atžvilgiu.
In this work, there is an analysis of the purpose and practice of the Republic of Lithuania Law on Compensation for State Social Insurance Old-age Pensions and State social Insurance Work Incapacity (Invalidity) Pensions. It is noteworthy that after the analysis of the order of the law governing compensations, it is clear that there is no legal possibility to inherit the pension’s compensation from a deceased pensioner. With this law, the pensions are returned only to those persons, who lived before this law was inured. This situational requires detailed analysis of the particular legal documents, regulations and legislation in order to interpret and justify the heir’s right for compensating the pensions. During the analysis of the inheritance issue in the pension’s compensation law, the attention was put not only on the theoretical but also on the practical side of the issue. In order to achieve a better legal debate, there was an analysis of the pension provision, the legal regulation of its functioning and protection. In order to determine whether the deceased pensioner’s relatives had to be included in the Republic of Lithuania Law on Compensation for State Social Insurance Old-age Pensions and State social Insurance Work Incapacity (Invalidity) Pensions, there was an analysis whether the pension is a personal right to property or whether deceased pensioners’ inheritance law is passed onto their heirs. Is the legislator violates the principle of equality and does not ensure the legitimate expectations protection principle by not mentioning the heirs in this law. The first part of the work describes the change of the States social insurance pension system from the re-establishment of the Lithuania’s independence till present days; there is summarized description of all pensions’ reforms, the objectives of the reforms and the benefits for Lithuania. However, most of the attention, in this part, is put on the Republic of Lithuania Law on Compensation for State Social Insurance Old-age Pensions and State social Insurance Work Incapacity (Invalidity) Pensions; the origination reasons and circumstances as well as the introduction of the compensations order are presented. In the second part of the work, the analysis of the scholar literature, legislation and case law are enclosed in order to ascertain whether the legislature do not breach the deceased pensioners’ heirs right to property by adopting the Republic of Lithuania Law on Compensation for State Social Insurance Old-age Pensions and State social Insurance Work Incapacity (Invalidity) Pensions. First of all, during the analysis of the deceased pensioners’ heirs’ rights in this law it is revised whether social benefits fall into the scope of the property and protection law. In the third part of the work the comparative analysis of the social protection doctrines’ restrictions of the Constitutional Courts of the Republic of Lithuania and the Republic of Latvia is conducted. During the worldwide economical crisis the parliaments of the Republics of Latvia and Lithuania decided to lower the pensions in order to counter the growing social insurance deficit, which was caused by the instability of the financial fund. After the analysis the following conclusion can be made: the Constitutional Courts of the Republics of Latvia and Lithuania have differently resolved the issues of the pensions’ reduction during the economic crisis. The Constitutional Court of the Republic of Lithuania social security doctrine and the European Court of Human Rights reveal that individual’s right to a pension is individual’s right to property. Thus, the person, who receives a pension as a property holder of subjective rights, has the right to request that others would not violate his/hers rights; the state must justify individual’s legitimate expectations as well as ensure the protection of this property right. The detailed analysis confirms that the deceased person’s property right, in this case “state debt”, is transferred to the heirs. In order to solve the analysed problem, it is suggested to formulate the Republic of Lithuania Law on Compensation for State Social Insurance Old-age Pensions and State social Insurance Work Incapacity (Invalidity) Pensions in such a manner that the property inheritance rights would not be violated.
