Ar tikslinga kriminalizuoti tapatybės vagystę fizinėje erdvėje Lietuvos Respublikos baudžiamajame kodekse?

Šiame magistriniame darbe nagrinėja tema – ar tikslinga kriminalizuoti tapatybės vagystę fizinėje erdvėje, Lietuvos Respublikos baudžiamajame kodekse? Iškeliama hipotezė, kad tapatybės vagystė Lietuvoje nėra teisiškai reglamentuota, todėl būtų tikslinga kriminalizuoti tapatybės vagystę baudžiamajame kodekse kaip atskirą nusikalstamą veiką, siekiant suteikti žmonėms daugiau žinių bei galimybių apsisaugoti nuo tokio pobūdžio nusikaltimų. Darbe susikoncentruota į tapatybės vagystę fizinėje erdvėje. Kita erdvė, kurioje taip pat galimos tapatybės vagystės, tai yra elektroninė erdvė, šiame darbe neanalizuojama. Atlikus tyrimą hipotezė pasitvirtino. Tapatybei identifikuoti fizinėje erdvėje naudojami asmenį identifikuojantys dokumentai. Tapatybės vagystė – tai yra nusikalstama veika susidedanti iš dviejų komponentų, tai yra asmens tapatybę identifikuojančios informacijos pasisavinimas bei jos panaudojimas siekiant naudos. Dažniausiai siekiama finansinės naudos. Pagrindinė tapatybės vagystės forma fizinėje erdvėje yra asmenį identifikuojančio dokumento ar jam prilyginamo dokumento pasisavinimas ir panaudojimas. Atlikus tyrimą paaiškėjo, kad Lietuvos gyventojams trūksta žinių apie tapatybės vagystę, jos formas, kylančias grėsmes. Apie pusę Lietuvos gyventojų, 49,4 proc., nežino, kas yra tapatybės vagystė, tapatybės vagystės suvokimas nėra pakankamas. Šiame darbe apžvelgiami JAV, Europos bei Lietuvos tapatybės vagystės kriminalizavimo aspektai. JAV tapatybės vagystė yra kriminalizuojama jau seniai. Apie ją kalbama ne tik JAV kodekse (U. S. Code), bet taip pat yra išleisti ir atskiri įstatymai skirti tapatybės vagystei. Tokie dokumentai yra Identity Theft Penalty Enhancement Act, Identity Theft and Assumption Deterrence Act of 1998. Su šio pobūdžio nusikaltimais efektyviai kovojama. Tuo tarpu Europoje tapatybės vagystę yra kriminalizavusios tik 4 valstybės, tai yra Estija, Portugalija, Prancūzija, Slovėnija. Daugumoje kitų valstybių baudžiamuosiuose kodeksuose naudojamos tokios sąvokos kaip piktnaudžiavimas tapatybe, sukčiavimas naudojant asmens tapatybę. Lietuvoje tapatybės vagystė fizinėje erdvėje nėra kriminalizuota. Ši veika kvalifikuojama kaip dokumento pagrobimas arba pagrobtojo panaudojimas pagal Lietuvos Respublikos baudžiamojo kodekso 302 straipsnį, kartu su sukčiavimu, pagal Lietuvos Respublikos baudžiamojo kodekso 182 straipsnį. Taigi, nors Lietuvoje tapatybės vagystė fizinėje erdvėje nėra kriminalizuota, šiuo metu egzistuojančių apsaugos mechanizmų pilnai užtenka kovai su tokio pobūdžio nusikaltimais. Vis dėlto, kriminalizavus tokio pobūdžio nusikaltimus, žmonės būtų labiau informuoti apie tapatybės vagyste, bei turėtų didesnes galimybes nuo jų apsisaugoti.
This Master’s thesis topic is–Is It Necessary to Criminalize Identity Theft in the Physical Space in the Criminal Code of Republic of Lithuania? In the beginning hypothesis is held that identity theft in Lithuania is not legally regulated, so it would be appropriate to criminalize identity theft in the Criminal Code as a separate offense, in order to give people the knowledge and ability to protect itself against this kind of crime. This paper focused on the identity theft in the physical space. In this paper hypothesis is confirmed. Personal identification documents are used to identify someone in the physical space. There is no officially accepted definition of identity theft. In general,identity theft is an offense consisting of two components.The first one is an uptake of someone’s personal identifiable information.The second one is an utilization of that taken information for the benefit of the theft. That benefit is mostly aimed for financial gain. The main form of identity theft in the physical space is personally identifiable documents or its equivalent documents uptake and utilization. The study initiated by Lithuania Consumer Institute showed that Lithuanian citizens lack knowledge about identity theftand its forms of threats. About half of Lithuania's population, 49.4 per cent, does not know what identity theft is, their understanding of identity theft is not sufficient. That is basically because Lithuania citizens are not informed about this type of crimes enough. People of Lithuania would be more aware of such type of crime if identity theft is criminalized in Criminal Code of Republic of Lithuania. This paper provides an overview of the US, European and Lithuanian identity theft criminalization aspects. In US identity theft is criminalized some time ago. It is mentioned in the laws such as U. S. Code, Identity Theft and Assumption Deterrence Act of 1998 and also Identity Theft Penalty Enhancement Act. In US identity theft is effectively combated. In Europe identity theft is only criminalized in 4 states. These are Estonia, Poland, France, Slovenia. In the laws of the most other countries instead of term “identity theft” there are used terms such as “identity fraud” or “identity crime’. Lithuania identity theft in the physical space is not criminalized. To incriminate this type of crimes it is usedArticle 302. Seizure of a Seal, Stamp or Document or Use of the Seized Seal, Stamp or Document together with Article 182.Swindling.of Criminal code of Republic of Lithuania. In conclusion, in Lithuania identity theft in the physical space is not criminalized by any laws, but it should be, even thought, currently existing protection mechanisms are fully sufficient to fight this type of crime. Criminalizing Identity theft in the physical space would facilitate the work of courts incriminating this kind of criminal offenses. Also, it would help informing Lithuanian residents about this type of crime. As mentioned above, Lithuanian citizens are not fully aware of the identity theft.
