Ar LR transporto priemonių savininkų ir valdytojų privalomojo draudimo civilinės atsakomybės įstatyme reglamentuojamas civilinės atsakomybės ribojimas dėl neturtinės žalos atlyginimo nepažeidžia draudėjų ir nukentėjusiųjų interesų?

Nuo 2002 m. sausio 1 d. privalomasis vairuotojų civilinės atsakomybės draudimas Lietuvoje yra privalomoji draudimo rūšis. LR transporto priemonių valdytojų civilinės atsakomybės privalomojo draudimo įstatymo 11 str. 1 d. numatyta, kad „<...> Transporto priemonių valdytojų civilinės atsakomybės privalomojo draudimo suma dėl vieno eismo įvykio Lietuvos Respublikos teritorijoje, nepaisant to, kiek yra nukentėjusių trečiųjų asmenų, yra: 1) nuo 2009 m. gruodžio 11 d. iki 2012 m. birželio 10 d. – 2 500 000 eurų dėl žalos asmeniui (taip pat 2 500 eurų dėl neturtinės žalos) ir 500 000 eurų dėl žalos turtui <...>“ Iš šio įstatymo matyti, kad draudimo bendrovė, automobilių savininkų ir valdytojų civilinę atsakomybę, dėl eismo įvykio patirtą nukentėjusio asmens neturinę žalą nukentėjusiajam atlygina tik tam tikrose ribose. Darbo tikslas yra atsakyti į klausimą, ar LR transporto priemonių valdytojų civilinės atsakomybės privalomojo draudimo įstatyme reglamentuojamas civilinės atsakomybės ribojimas dėl neturtinės žalos atlyginimo nepažeidžia draudėjų ir nukentėjusiųjų interesų. 2005-05-11 Europos Parlamento ir Tarybos direktyvos 2005/14/EB 2 str. 2d. nurodyta, kad „<...> Nepažeisdama jokių didesnių garantijų, kurias gali nustatyti valstybės narės, kiekviena valstybė narė reikalauja, kad privalomojo draudimo sumos būtų ne mažesnės kaip: a) žalos asmeniui atveju – mažiausia atlyginama suma, sudaranti 1 000 000 EUR kiekvienam nukentėjusiam asmeniui arba 5 000 000 EUR kiekvienam žalos atlyginimo reikalavimui (įvykiui), nepriklausomai nuo nukentėjusių asmenų skaičiaus; <...>“. Iš cituoto teksto matyti, kad direktyvoje nėra nurodyta sumos apribojimo neturtinei žalai. Priešingai, direktyvos tekstas numato bendrą žalos asmeniui atlyginimą ir maksimalią pagal nacionalinius įstatymus atlygintiną sumą, kurios minimumas yra reglamentuojamas šia direktyva. To paties direktyvos straipsnio 2 dalies b punkte reglamentuotas žalos atlyginimas turtui. Taigi manytina, kad direktyvoje minima žalos asmeniui sąvoka apima tiek turtinę, tiek ir neturtinę žalą ir būtent šių rūšių žalų suma, įtvirtinta nacionaliniuose įstatymuose, privalo būti ne mažesnė nei 1 000 000 eurų kiekvienam asmeniui arba 5 000 000 eurų vienam eismo įvykiui. Tokia išvada darytina analizuojant ir direktyvos preambulės 10p., 20p., 21p., kurie įtvirtina direktyvos siekiamus tikslus, t.y. kad būtų garantuota eismo įvykiuose nukentėjusių asmenų apsauga jiems visiškai ir sąžiningai atlyginant padarytą žalą. Tokia pat nuostata buvo įtvirtina ir 1983-12-30 Antrojoje Europos Tarybos direktyvos Nr. 84/5/EEB preambulėje „<...> kadangi privalomojo draudimo sumos bet kuriuo atveju turi garantuoti nukentėjusiems asmenims deramą žalos atlyginimą <...>“. 1972-04-24 Europos Tarybos direktyvoje Nr. 72/166/EEB apibrėžta, kad „Nukentėjusioji šalis – tai bet kuris asmuo, turintis teisę gauti transporto priemone padaryto bet kokio nuostolio ar žalos atlyginimą.“, t.y. direktyva neriboja žalos atlyginimo priklausomai nuo to, turtinė tai ar neturtinė žala. Atsižvelgiant į aukščiau išdėstytą toks Lietuvos Respublikos teisinis reglamentavimas pažeidžia nukentėjusiųjų asmenų ir draudėjų interesus, nes Europos sąjungos aktai ir teisės literatūroje iš bendros žalos asmeniui nėra išskiriama neturtinė žala, o įstatymų leidėjas, ribodamas neturinės žalos atlyginimą iš draudiko, tokiu būdu pažeidžia nukentėjusiųjų interesus, nes sumažina galimybes prisiteisti teisingą neturtinės žalos atlyginimo dydį, tuo pačiu sumažindamas neturtinės žalos išieškojimo galimybes. Kita vertus toks teisinis reglamentavimas tuo pačiu ir apsaugo draudėjų interesus, nes neribojant neturtinės žalos atlyginimo iš draudiko, privalomasis transporto valdytojų civilinės atsakomybės draudimas taptų per sunkia našta draudėjams, kadangi nebijant neturtinės žalos atlyginimo, draudimo įmoka ženkliai pabrangtų.
Since the 1st of January 2002 the driver‘s compulsory civil liability insurance is the obligatory form of insurance in Lithuania. The 1st part of the 11th article of the vehicle owner‘s compulsory civil liability insurance Law of the Republic of Lithuania predicts that „<...> the sum of the vehicle owner‘s compulsory civil liability insurance regarding one accident in the boarders of the territory of the Republic of Lithuania, despite the number of the aggrieved third parties, is equal to: 1) since the 11th of December until the 10th of June 2012- 2 500 000 Euros for personal injury (also 2 500 Euros for the non-pecuniary damage) and 500 00 Euros for the property damage”. The purpose of the thesis is to provide the answer to the question, does the limitation of the civil liability regulated by the vehicle owners compulsory civil liability insurance Law of the Republic of Lithuania regarding compensation of the non-pecuniary damage infringes or not the interests of assured and injured persons. Summarising the material sited in the thesis it can be concluded that the limitation of non-pecuniary damage compensation from the side of insurer intended within the vehicle owner‘s compulsory civil liability insurance Law of the Republic of Lithuania violates the interests of victims and insurers, because: - Given the above outlined information such legal regulation of the Republic of Lithuania violates the interests of the injured persons and assured ones, because the Acts of the European Union and the legal literature sources the non-pecuniary damage is not excluded from the general damage to a person, and the legislator restricting compensation of the non-pecuniary damage from a side of insurer in such way violates the interests of the victims, because the opportunities to adjudge the right size of the damage compensation are reduced, also are reduced the opportunities of the non-pecuniary damage recovery. - Tthe non-pecuniary damage for its character is the inherent part of the damage caused to the person‘s health and life, and the in the legal relations based by the vehicle owner‘s compulsory civil liability insurance, the insurer while undertaking to pay the insurance premium for a damage in regard of the person equally commits to compensate the damage to the third parties within the pale of the insurance sum, whereas the circumstance that the compensation of non-pecuniary damage is not definitely mentioned in the Law doesn‘t have any importance and doesn‘t make a basis to explain the conception of the damage caused to a person in prejudice of assurer and a victim and to relieve the insurer from the obligation to compensate it fully. After review of legislation and case law within this thesis is assumed that the damage in regard of a person also includes non-pecuniary damage. In such case a victim has a limited opportunity to adjudge the non-pecuniary damage from the insurer or solidary from the insurer and the guilty person, i.e. the right of a victim to the equitable monetary compensation is limited- the person is induced to appeal to the Court for the adjudgement of the non-pecuniary damage from the guilty person (while property issues can be resolved with the insurer without appeal to the Court), whereas this requires additional resources. - Within the Laws of some European Union states (France, Belgium, Germany, United Kingdom and etc.) aren’t predicted the limitations of non-peculiar damage compensation. The extent of the moral damage through the monetary aspect in such states is evaluated by the Court fallowing the settled case law. But within the Law of some foreign states (Estonia, Latvia, Denmark) is the principle, restricting the compensation of the non-peculiar damage according to the vehicle owner‘s compulsory civil liability insurance agreements. - Because the extent of the non-pecuniary damage is determined taking into account the defendant‘s personal property position, his/her interests, fair and rationality criterions, while averting the compensation of the non-peculiar damage only towards the perpetrator can be expected the Po compensation of non-peculiar damage, than from an insurance company, because the above mentioned criterions wouldn‘t be applied. - The guilty person (insurer) while insuring his/her civil liability reasonably expects full compensation of the damage from the insurer, therefore the compensation of non-peculiar damage from the guilty person violates the interests of the guilty person. Whereas the Directive of the European Union doesn‘t distinguish the limitation of the non-peculiar damage, the responsibility of damage compensation is poorly targeted, in such way the interests of insurers are violated; - While adjudging the compensation of non-peculiar damage is evaluated the probability of the real reception of the adjudged compensation, recovery from the defendant, while directing the recovery of the compensation towards the insurer (or solidary towards the insurer and the guilty person), in such case the probability of recovery would highly increase, resulting the increased size of the adjudged compensation. While summarising the material set out in the thesis it can be concluded that the limitation of the non-peculiar damage compensation from the insurer provided within the vehicle owner‘s compulsory civil liability insurance Law of the Republic of Lithuania at the same time protects the interests of insurers, because: - Through such regulation the legislator seeks for the general public welfare, i.e. to protect not only the interests of victims, but also the interests of insurers and assured. Because all vehicles must be compulsorily insured with the vehicle owners‘ civil liability insurance, this liability shouldn‘t be too much complicating for the assurers. If there wouldn‘t be limited the compensation of non-peculiar damage, the fee for insurance would significantly increase, in such case the assurers would be disproportionately burdened. So, the hypothesis raised within this thesis that the limitation of non-peculiar damage for the victim through the vehicle owner‘s compulsory civil liability insurance Law of the Republic of Lithuania violates the interests of assurers and victims was partially confirmed, i.e. the interests of the victims and assurers through such regulation are violated, but the interests of assurers through such legal regulation are equally protected.
