Komentare, remiantis aktualia Europos Sąjungos teisingumo teismo jurisprudencija, analizuojama, ar ir kuriais atvejais Valstybėms narėms gali kilti pareiga tiesiogiai taikyti ES direktyvos nuostatas baudžiamajame procese vietoje nacionalinių teisės aktų, t. y. diskutuojama apie direktyvų tiesioginio taikymo galimybes.
Abstract (en)
The commentary, on the basis of the relevant case law of the Court of Justice of the European Union, analyzes whether and in which cases Member States may be required to apply the provisions of an EU directive directly in criminal proceedings instead of national law, i. e. the possibility of direct application of directives is being discussed.
