    The article presents the development and application of criminal law providing responsibility for the criminal acts against the economy and business order in accordance with the Constitutional requirements. The article reveals the Constitutional requirements of the development and application of criminal law. The authors analyse whether these requirements are respected in legislation and case law in applying the norms relating to criminal liability for the criminal acts against the economy and business order. The analysis of both the criminal law and its application shows that the legislator and the court do not always comply with these Constitutional requirements. The authors have concluded that nowadays Constitutional norms and principles have a significant impact on the criminal law, particularly, in applying the norms providing criminal liability for the criminal acts against the economy and business order. It draws attention to the fact that the Constitutional requirements are of special value in applying these norms because of their uncertainty and ambiguity. On the basis of the analysis performed in the article, the authors propose courts to follow the Constitutional reasonableness, proportionality, and to respect the Constitutional requirements concerning the purpose of criminal liability and the delimitation of criminal and other offenses while applying criminal liability for these offenses.
