Ar dėl pernelyg ilgos baudžiamojo proceso trukmės yra užtikrinamos veiksmingos ir efektyvios gynybos priemonės švelninant bausmę ir atlyginant patirtą žalą Lietuvos Respublikoje?

Šiame magistro darbe buvo siekiama atsakyti į klausimą, ar dėl pernelyg ilgos baudžiamojo proceso trukmės yra užtikrinamos veiksmingos ir efektyvios gynybos priemonės, švelninant bausmę ir atlyginant patirtą žalą Lietuvos Respublikoje.
Darbe buvo analizuojama proceso greitumo principo samprata, jo reikšmė žmogaus teisių gynimo kontekste, ypatingai tais atvejais kuomet nagrinėjamos baudžiamojo proceso bylos, nuo kurių išsprendimo priklauso kaltinamo asmens teisių užtikrinimas.
Proceso greitumo principo užtikrinimo reikalauja ne tik tarptautiniai įsipareigojimai, bet ir regioninė Europos žmogaus teisių ir pagrindinių laisvių apsaugos konvencija (toliau – Konvencija), kurios 6 straipsnyje numatyta, kad valstybės ratifikavusios šią Konvenciją turi pareigą užtikrinti, kad byla būtų išnagrinėta per įmanomai trumpiausią laiką. Tam kad būtų galima pasinaudoti Konvencijos suteikiamomis teisėmis, atvejis turi atitikti ,,baudžiamojo kaltinimo sąvoką‘‘, kurią apibrėžė Europos žmogaus teisių teismas (toliau – EŽTT), nepriklausomai kaip šią sąvoką interpretuoja Konvencijos valstybės dalyvės.
Tam, kad būtų nustatyta ar buvo pažeistas įmanomai trumpiausio laiko reikalavimas, EŽTT pagal suformuotus kriterijus t. y., baudžiamojo proceso trukmės skaičiavimo kriterijus, bylos sudėtingumą, teisėsaugos institucijų veiksmus tiriant ir nagrinėjant bylas, ir pareiškėjo elgesį, nustato ar buvo padarytas pažeidimas. Valstybės Konvencijos dalyvės įsipareigojusios užtikrinti, kad būtų laikomasi kaip įmanoma trumpesnio laiko, per kurį turi būti išspręsta byla. Pažeidimo atveju, asmeniui patyrusiam žalą, turi būti atlyginta. Dažniausiai sutinkamas žalos atlyginimo būdas Lietuvos Respublikos (toliau – Lietuva) baudžiamajame procese yra bausmės sušvelninimas. Pagal Konvenciją valstybė neužtikrinusi pozityviosios pareigos garantuoti Konvencijoje įtvirtintas žmogaus teises ir laisves, turi veiksmingomis, ir efektyviomis gynybos priemonėmis, kurios numatytos Konvencijos 13 straipsnyje užtikrinti žalos atlyginimą, nacionalinės teisės priemonėmis. Lietuvoje, dar nėra normų, kuriose būtų įtvirtintos veiksmingos teisinės gynybos priemonės, kurios užtikrintų dėl valstybės institucijų pernelyg ilgo bylos nagrinėjimo, atsiradusios žalos kompensavimą. Kitose Konvencijos valstybėse dalyvėse, numatyta konkrečiuose norminiuose aktuose, valstybės pareiga - sušvelninti bausmę išimtinai dėl pernelyg ilgo baudžiamojo proceso. Tokių priemonių numatymas sumažina bylų skaičių EŽTT, dėl pernelyg ilgo proceso, nes kaltinamieji patyrę žalą turi galimybę tiesiogiai kreiptis į savo valstybės nacionalinius teismus ir atgauti žalą. Veiksmingų teisinių gynybos priemonių numatymas nacionalinės teisės aktuose, ne tik palengvina žalos atlyginimą, bet ir užtikrina Konvencijos laikymąsi.
Kita žalos atlyginimo forma yra žalos atlyginimas civilinio proceso tvarka, tai yra kraštutinė priemonė, kuomet kiti žalos atlyginimo būdai negalimi pvz.: bausmės sušvelninimas negalimas, jei tai prieštarauja teisingumo principui. Tačiau Lietuvoje nėra teisės akto, kuris reguliuotų valstybės deliktinės atsakomybės klausimą, dėl pernelyg ilgo proceso padarytos žalos atlyginimo. Todėl ir šiuo atveju neužtikrinama Konvencijos 13 straipsnyje įtvirtinta asmens teisė, nacionalinėmis teisinėmis priemonėmis ginti pažeistas teises, kurios būtų efektyvios ir veiksmingos.
The Master thesis aims to answer the question whether the efficient and effective remedies to mitigate the penalty and compensate for the damage suffered are guaranteed during the excessively long criminal proceedings in the Republic of Lithuania. This topic has not been widely analyzed in the Republic of Lithuania (hereinafter - Lithuania), the analysis is limited to some statements on state’s contractual liability for the damage caused by the state law enforcement officials for their illegal actions, without further analysis of compensation of the damage for the excessively long proceedings. The mitigation of punishment has not been analyzed by the Lithuanian scientists exclusively on the excessively long proceedings, though in judicial practice the punishment is often mitigated because of the excessive length of the proceedings.
The relevance of this problem is undoubted just taking a look at the number of cases in the European Court of Human Rights (hereafter - the ECHR) regarding infringement of Article 6 of the European Convention on Human Rights and Fundamental Freedoms (hereinafter - the Convention), regarding the length of proceedings. In Lithuania, the highest number of violations from all violations of the Convention committed by the public institutions is related to namely the excessive length of the proceedings. The following conclusions have been drawn based on the analysis of various scientific sources, the practice of national courts and the ECHR, as well as national and international laws.
The thesis has analyzed the concept of the process speed, its importance in the context of defense of human rights, especially in cases of criminal procedure, where the assurance of the accused person's rights depends on the judgment of the case. The principles have been divided into a hierarchical system where the principles established in the higher power acts should take precedence over the principles of the lower power acts. The principles of the same hierarchical level must also be matched otherwise the essence of the legal system will be distorted.
The assurance of the principle of process speed is required not only by the international obligations but also by the European Regional Convention, Article 6 of which provides that the Member States that have ratified the Convention are obliged to ensure that the case shall be examined within a reasonable time. In order to benefit from the rights granted by the Convention, the case must comply with the concept of “criminal charge” that has been defined by the ECHR, regardless of how this concept is interpreted by the States of the Convention. The main reason is to prevent the state abuse, which can prevent the people who have been harmed to receive an adequate compensation.
In order to determine whether the requirement of the reasonably shortest time has been violated, the ECHR, according to its criteria, determines whether the offense has been committed, and who is to blame. It should be noted that all the criteria, i.e. criteria counting of criminal procedure period, complexity of the case, the actions of law enforcement authorities investigating and analyze case and the applicant's conduct must be considered together, because they will determine whether the punishment will be mitigated or whether the damage will be compensated in the civil procedure.
The State Parties to the Convention are committed to ensure the compliance with the shortest possible time in which the case shall be solved. In case of infringement, the person who has suffered damage must be compensated for the damage. The most common way to compensate for the damage in the Lithuanian criminal proceedings is the mitigation of the punishment. Under the Convention, the State that is not ensuring a positive obligation to guarantee the human rights and freedoms established in the Convention shall take efficient and effective remedies provided for in Article 13 of the Convention to ensure the compensation of damage by the means of national law. Lithuania yet does not have any effective remedies established in the laws to ensure the compensation for the damage incurred because of the excessively long proceedings in the public institutions. Other participating States of the Convention provide for the duty of the state to mitigate the sentence in the specific regulatory acts exclusively on the excessively long criminal proceedings. Anticipating of such measures reduces the number of cases in the ECHR concerning the excessive length of the proceedings because the accused persons suffered damage are able to contact the state national courts and recover the damages. The anticipation of the effective legal remedies in national legislation not only facilitates compensation of the damage, but also ensures compliance with the Convention.
Other form for compensation of damages is the compensation of damages under civil procedures, this is a last resort when all other means for compensation of damage are not possible, for example, the mitigation of the punishment is not possible, if this is contrary to the principle of justice. However, Lithuania does not have a legal act which regulates the question of the state's contractual liability regarding compensation of damage due to the excessive length of the proceedings. Neither the law of the Republic of Lithuania on the compensation of the damage caused by the illegal actions of the state authorities, nor the Civil Code provide for the basis for compensation of the damage due to the excessive length of the criminal proceedings. Therefore, in this case the right of individuals to use national legislative measures that are efficient and effective to protect the violated rights established in Article 13 of the Convention is not guaranteed.
It is recommended to establish the following provisions in the Lithuanian national law: the Criminal Code shall provide for that the punishment may be mitigated if the length of the process was too long because of the fault of public officials, and the Civil Code shall provide for that the damage suffered because of the excessively long criminal proceedings caused by the state authorities in their unlawful actions shall be compensated by the state.
