Ar susitaikymo institutas, numatytas BK 38 str., neprieštarauja teisingumo ir baudžiamosios atsakomybės neišvengiamumo principams?

Darbe tiriama ar susitaikymo institutas, numatytas Lietuvos Respublikos baudžiamojo kodekso 38 straipsnyje neprieštarauja teisingumo ir baudžiamosios atsakomybės neišvengiamumo principams, kurie apibrėžiami kaip pagrindinės, atraminės idėjos, pamatinės nuostatos, esminiai teisės pradai, nulemiantys baudžiamosios atsakomybės esmę bei jos paskirtį ir jas išreiškia. Šio darbo tikslas yra nustatyti ir atskleisti susitaikymo instituto praktinį taikymą Lietuvos Respublikos baudžiamojoje teisėje bei vertinti jį teisingumo ir baudžiamosios atsakomybės neišvengiamumo principų kontekste. Pirmojoje darbo dalyje išskiriamas susitaikymo institutas, jo reglamentavimas, funkcijos bei tikslai. Taip pat aprašomuoju tyrimo metodu, teoriniu aspektu atskleidžiama ir analizuojama susitaikymo instituto sąvoka, taikymas, probleminiai aspektai. Antrojoje darbo dalyje nagrinėjami baudžiamosios teisės principai. Išskiriami teisingumo ir baudžiamosios atsakomybės neišvengiamumo principai, jų turinys, požymiai bei raida Lietuvos teisinėje sistemoje. Taip pat atkreipiamas dėmesys į praktiką taikant šiuos principus baudžiamojoje teisėje. Trečiojoje darbo dalyje atskleidžiamas teisės normos ir principo santykis, susitaikymo institutas, numatytas BK. 38 str., nagrinėjamas ne tik teoriniu, bet ir praktiniu lygmeniu. Darbe sisteminiu tyrimo metodu analizuojamas šio instituto taikymas ir neatitikimai teisingumo bei baudžiamosios atsakomybės neišvengiamumo principams, analizuojamos nutartys, kuriuose nusikalstamą veiką padaręs asmuo atleidžiamas nuo baudžiamosios atsakomybės BK 38 str. pagrindu. Šioje dalyje išskiriami požymiai, leidžiantys manyti, kad susitaikymo institutas gali pažeisti baudžiamosios teisės principus, tokius, kaip teisingumas ir baudžiamosios atsakomybės neišvengiamumas. Taip pat atsakoma į klausimą dėl susitaikymo instituto taikymo LR baudžiamojoje teisėje teisingumo ir atsakomybės neišvengiamumo principų kontekste. Darbo paskutinėje dalyje naudojant loginį analitinį teisės tyrimo metodą apibendrinamas ir atskleidžiamas darbo tyrimo rezultatas – Lietuvos Respublikos baudžiamojoje teisėje neįžvelgiamas vyraujantis baudžiamosios atsakomybės išvengiamumo ir teisingumo principo pažeidimas. Prieinama išvada jog darbo pradžioje išsikelta hipotezė nepasitvirtino – susitaikymo institutas, numatytas BK 38 str., neprieštarauja teisingumo ir baudžiamosios atsakomybės neišvengiamumo principams.
Conciliation in criminal proceedings is one of the types of release from criminal liability subject to a condition that the person who has committed a criminal act may be released from criminal liability on decision of the court by establishing a one year probation period, provided that both parties reach an agreement of their free will. The institute of conciliation of the perpetrator and the aggrieved party is applied in many countries developed economically and socially. Elements of such institute are also present in the Criminal Code of the Republic of Lithuania. Using the logical-analytical, comparative and systematic methods, the paper examines whether the conciliation institute provided for in Article 38 of the Criminal Code of the Republic of Lithuania does not contradict the principles of justice and unavoidability of criminal liability, which are defined as the main underlying ideas, fundamental provisions and tenets of the law that determine the key point and purpose of criminal liability. The main goals set in the final paper are the following: analysing the conciliation institute while distinguishing its theoretical and practical aspects; analysing the principles of justice and unavoidability of criminal liability, their concepts, attributes and contents; and revealing the contradictions that might arise due to the conciliation institute to the principles of justice and unavoidability of criminal liability. The main objective of the paper is to establish and disclose the practical application of the conciliation institute in criminal law of the Republic of Lithuania and to assess it in the context of principles of justice and unavoidability of criminal liability. The first part of the paper elaborates on the conciliation institute, its regulation, functions and objectives. Moreover, the conception of the conciliation institute, its application and key objectives are disclosed and analysed from the theoretical point of view, using the descriptive method of research. The second part of the paper examines the principles of the criminal law. Principles of justice and unavoidability of criminal liability are distinguished as well as their attributes and contents. Moreover, attention is drawn to the practice when applying these principles in criminal law. The third part of the paper reveals the relation of the rule of law and principle; the conciliation institute provided for in Article 38 of the Criminal Code of the Republic of Lithuania is examined on the theoretical and practical plane. Using the systematic research method, the paper analyses the application of this institute and contradictions to the principles of justice and unavoidability of criminal liability. Rulings are analysed where the individuals who committed criminal acts were released from criminal liability on the grounds of Article 38 of the Criminal Code. This part distinguishes the attributes, which allow believing that the conciliation institute might violate such principles of the criminal law as justice and unavoidability of criminal liability. Furthermore, the application of the conciliation institute in the criminal law of the Republic of Lithuania is examined in the context of principles of justice and unavoidability of criminal liability. The final part of the paper summarises and reveals the findings using the logical-analytical method of legal research: in the criminal law of the Republic of Lithuania, no prevailing violations of the principles of justice and unavoidability of criminal liability could be observed. It is concluded that the hypothesis raised at the beginning of research was not validated: the conciliation institute provided for in Article 38 of the Criminal Code does not contradict the principles of justice and unavoidability of criminal liability.
