Nors įstatymų leidybos fone gali atrodyti, kad asmenų, turinčių klausos negalią, problemos yra įveikiamos, realių sėkmingos įtraukties pavyzdžių pasitelkiant lietuvių gestų kalbą visuomenėje trūksta, lygiai taip pat kaip trūksta lietuvių gestų kalbos teisinio reglamentavimo. Tyrimo objektas – asmenų, turinčių klausos negalią, socialinės įtraukties į visuomenę įgyvendinimas per gestų kalbos įteisinimą. Tyrimo tikslas – atskleisti asmenų, turinčių klausos negalią, socialinės įtraukties į visuomenę ypatumus, argumentuojant lietuvių gestų kalbos įteisinimą. Siekiant įgyvendinti numatytą tikslą, buvo keliami trys tyrimo uždaviniai: atskleisti asmenų, turinčių klausos negalią, viešųjų paslaugų prieinamumo užtikrinimo praktiką, remiantis ekspertų požiūriu; atskleisti lietuvių gestų kalbos formalaus teisinio reguliavimo atitiktį realiai praktikai, remiantis ekspertų požiūriu; aprašyti norimus pokyčius, ekspertų požiūriu, lietuvių gestų kalbos teisinio reguliavimo link. Darbe aptarta klausos negalią turinčių asmenų pasaulinė istorija, istorija Lietuvoje ir jos svarba darbui su asmenimis, turinčiais klausos negalią. Apžvelgta teisinė asmenų, turinčių klausos negalią, padėtis bei pabrėžti socializacijos laimėjimai. Išskirtos pagrindinės kliūtys, su kuriomis susiduria kurtieji kasdienėje veikloje. Atkreiptas dėmesys į žmogaus teises: teisę į gimtąją kalbą, į prieinamumą, į savarankišką gyvenimą, į inkliuzijos galimybes. Tyrime buvo aprašyta ir atskleista asmenų, turinčių klausos negalią, viešųjų paslaugų prieinamumo užtikrinimo praktika, kuri šiuo metu nėra ypač pozityvi. Tyrimo metu išryškėjo gestų kalbos formalaus teisinio reguliavimo atitiktis realiai praktikai, nustatyta, kad nepakanka mokymo įstaigose gestų kalbos mokančių pedagogų, išryškintas poreikis įsteigti lietuvių gestų kalbos mokymo klases bei identifikuotas gestų kalbos tyrimų trūkumas. Tyrimo metu atsiskleidė gestų kalbos teisinio reguliavimo norimi pokyčiai, tokie kaip lietuvių gestų kalbos pripažinimas kaip atskiros kalbos. Taip pat gauti duomenys atskleidė, kad įteisinti ir sunorminti gestų kalbą yra sudėtinga dėl galiojančių teisės aktų, kvalifikuotų specialistų ir lėšų trūkumo.
Although it may seem that all law legislation obstacles of people with hearing disability have been overcome, however there are no real examples of successful inclusion into society by using Lithuanian sign language. Furthermore, there are lack of legal regulation of Lithuanian sign language. The object of the research is the social inclusion's implementation of people with hearing disability through the legalization of sign language. The aim of the research is to reveal the peculiarities of social inclusion of persons with hearing impairments in society, arguing the legalization of Lithuanian sign language. In order to achieve the goal, three research tasks were set: to reveal the practice of ensuring the accessibility of public services for persons with hearing impairments, based on expert opinion; to reveal the correspondence of the formal legal regulation of the Lithuanian sign language with the real practice, based on the expert point of view; to describe the desired changes, from the point of view of experts, towards the legal regulation of the Lithuanian sign language. Master thesis discusses the people's with hearing disability history, Lithuanian history and its importance for working with people with hearing disability. The legal situation of the people with hearing disability is reviewed, and the achievements of socialization are highlighted. The main obstacles faced by people with hearing disability their daily activities have been identified. Attention was paid to human rights: the right to the mother tongue language, to accessibility, to independent living, to the possibilities of inclusion. The study described and revealed the practice of ensuring the accessibility of public services for people with hearing disability, which is currently not very positive. During the research, compliance of the formal legal regulation of sign language with real practice has been revealed: it was established that there are not enough tutors who can teach sign language in educational institutions, the need to establish Lithuanian sign language teaching classes was highlighted and the lack of sign language research was identified. The study revealed the desired changes in the legal regulation of sign language, such as recognition of Lithuanian sign language as a separate language. The data also revealed that it is difficult to legalize and standardize sign language due to the lack of existing legislation, qualified professionals and resources.
