Abstract
Kriminalinės žvalgybos tyrimas tai organizacinė taktinė kriminalinės žvalgybos forma, kai esant kriminalinės žvalgybos tyrimo pagrindui šio įstatymo nustatyta tvarka naudojami kriminalinės žvalgybos informacijos rinkimo būdai ir priemonės siekiant įgyvendinti kriminalinės žvalgybos uždavinius. Remiantis Lietuvos teismų praktikos apžvalga, neretai pasitaiko situacijų, kai atliekant kriminalinės žvalgybos veiksmus ir jų metu surinktus duomenis teismai ne visada vertina kaip įrodymus primant nuosprendį baudžiamojoje byloje. Tokie duomenys neatitinka įrodymams būtinų leistinumo ir teisėtumo reikalavimų. Šiame moksliniame darbe yra nagrinėjamos pratikoje pasitaikančios situacijos, kai duomenys baudžiamojoje byloje buvo nepripažinti kaip įrodymai, nes buvo pažeistas teisėtumo ar leistinumo reikalavimas. Teismai, vertindami kriminalinės žvalgybos veiksmų metu surinktus duomenis, turi kruopščiai patikrinti, ar tokių veiksmų sankcionavimas bei įgyvendinimas atitinka konkrečių kriminalinės žvalgybos tyrimo veiksmų procesines formas ir joms keliamus reikalavimus ir tik tada juos laikyti įrodymais byloje priimant nuosprendį. Magistro baigiamąjį darbą sudaro įvadas, dėstomoji dalis, kurią sudaro trys atskiros struktūrinės dalys, išvados, santraukos lietuvių ir anglų kalbomis bei literatūros sąrašas. Pirmoje dalyje yra LR kriminalinės žvalgybos įstatymo apžvalga, veiksmų samprata. Antroje dalyje yra įrodymų sampratos apžvalga, teisėtumo ir leistinumo principų pagrindiniai aspektai. Trečioje dalyje yra aptarti kriminalinės žvalgybos veiksmų sankcionavimo ir realizavimo teisėtumo bei atsitiktinai surinktų duomenų panaudojimo atvejai. Darbo pabaigoje yra pateiktos išvados, kurios padarytos apibendrinant darbe nagrinėtas problemas.
In summary, judgments must be based on truth and evidence. It is the primary duty of the courts to conduct due process to properly assess the evidence. Many of the rules of evidence, which have evolved under different legal systems, have largely been based on experience and are shaped by a variety of legal requirements that determine what is admissible and sufficient evidence. The purpose and essence of criminal proceedings is to establish the truth in the case and make a fair final decision. The determination of the truth in the case is directly related to the restoration of the circumstances of the crime. The concept of evidence is not directly enshrined in the Code of Criminal Procedure of the Republic of Lithuania. According to the ruling of the Supreme Court of Lithuania, evidence in criminal proceedings is obtained in accordance with the law, verified in accordance with the Code of Criminal Procedure of the Republic of Lithuania, examined at trial and adjudicated by the court. Criminal Intelligence Investigation is an organizational tactical form of criminal intelligence, where, under the basis of criminal intelligence investigation, the methods and means of collecting criminal intelligence are used in order to carry out the tasks of criminal intelligence. Master's thesis consists of introduction, teaching part, which consists of three separate structural parts, conclusions, summaries in Lithuanian and English and list of literature. The first part contains the overview of the Criminal Intelligence Law of the Republic of Lithuania, the concept of actions. The second part provides an overview of the concept of evidence, the key aspects of the principles of legality and admissibility. The third part deals with the cases of the lawfulness of criminal intelligence actions and their realization and the use of randomly collected data. At the end of the thesis are given conclusions, which are made by summarizing the problems analyzed in the thesis.
