Ar Lietuvoje moksleiviams su specialiaisiais ugdymo poreikiais užtikrinama teisė į švietimą?

Teisę į švietimą užtikrina kiekviena išsivysčiusi valstybė. Vadovaujamasi nuostata, kad kiekvienas asmuo, nepriklausomai nuo jo fizinių, protinių ar kitų savybių, turi teisę įgyti išsilavinimą. Jeigu ši teisė garantuojama visiems, tai moksleiviai su specialiais ugdymo poreikiais turi lygias galimybes teisės į švietimą atžvilgiu. Pastaruoju metu mokslinėje literatūroje skiriama vis daugiau dėmesio vaikų su specialiaisias ugdymo poreikiais teisės į švietimą užtikrinimo klausimui. Tačiau Lietuvoje šio pobūdžio mokslinių darbų trūksta. Atsižvelgiant į tai, pasirinktas šio tyrimo objektas - moksleivių su specialiais ugdymo poreikiais teisės į švietimą Lietuvos teisinėje sistemoje apimtis. Tyrimo tikslas - atlikti moksleivių su specialiais ugdymo poreikiais teisės į švietimo Lietuvoje analizę. Siekiant įvardyto tikslo, darbe keliami šie uždaviniai: 1) išanalizuoti specialiųjų poreikių sampratą tarptautinėje teisėje; 2) išnagrinėti pagrindines teisės normas, užtikrinančias teisę į švietimą moksleiviams, turintiems specialiųjų ugdymo poreikių tarptautiniuose teisės aktuose; 3) išanalizuoti specialiųjų poreikių sampratą Lietuvos teisėje ją lyginant su samprata, įtvirtinta tarptautiniuose teisės aktuose; 4) išnagrinėti moksleivių su specialiaisiais ugdymo poreikiais teisių užtikrinimą reglamentuojančių teisės aktų pakankamumą Lietuvos teisėje. Atlikus tyrimą buvo nustatyta, kad Lietuvoje įtvirtintos teisės normos, užtikrinančios teisę į švietimą moksleiviams su specialiais ugdymo poreikiais, nuosekliai reprezentuoja tarptautines teisės normas. Pagrindinė darbe nustatyta problematika kyla iš specialiųjų poreikių sąvokos neapibrėžtumo ir nuoseklaus traktavimo trūkumo.
In every developed country the right to education should be guaranteed. It is usually considered that every person, regardless of his physical, mental or other qualities, which could separate him from the community, has the right to education. If this right is guaranteed to all, then children with special educational needs have equal access to education as well. The conducted research reveal that the current legislation of the Republic of Lithuania represents the basic internationally established norms of the general right to education for children with special educational needs: the principle of equal opportunities and priority for the needs and interests of the child and the right to non-discrimination and the right to life and development. As these norms in international law guarantee the right to education for children with special educational needs at least in the theoretical sense, it was concluded that it is guaranteed in Lithuania as well as. Therefore, it is said that the legal norms established in Lithuania ensuring the right to education for children with special educational needs consistently represent international legal norms. It was also found that Lithuanian court practice is consistently guided by the fundamental norms guaranteeing the right to education for children with special educational needs. The principle of the best interests of the child, which inevitably obligates respect for equal opportunities, non-discrimination and development and the rights of the child of the child, is at the heart of every decision regarding child’s future. The main problem identified in the research is the uncertainty of the concept of special needs and the lack of its consistent treatment in the law.
