Abstract
Piramidinė prekių platinimo sistema yra uždrausta daugelyje šalių, o tinklinė rinkodara yra legali. Tačiau šios abi sistemos turi bendrų bruožų, todėl yra painiojamos. Darbe yra analizuojama tinklinės rinkodaros ir piramidinės prekių platinimo sistemos esmė; nustatoma tinklinės rinkodaros ir piramidinės prekių platinimo sistemos raida; nesąžiningos komercinės veiklos draudimo priežastys, o taip pat analizuojama tinklinės rinkodaros ir piramidinės prekių platinimo sistemos atskyrimo kriterijai. Darbo tikslas - sistemiškai ir analitiškai išnagrinėti tinklinės rinkodaros ir prekių platinimo sistemos sampratą, atskleisti koki kriterijai yra taikomi tinklinei rinkodai ir piramidinei prekių platinimo sistemoms atskirti. Tyrimo objektas – požymiai, vienijantys ir skiriantys tinklinės rinkodaros ir piramidinės prekių platinimo sistemas. Aktualumas - darbo tema yra pakankamai nauja – apie tinklinę rinkodarą ir piramidinę prekių platinimo sistemas netyrinėta teisiniu aspektu. Darbe buvo naudojama dokumentų analizė, šio metodo pagalba buvo tiriami teisės aktai, JAV ir Lietuvos teismų praktika. Naudojamas lyginamasis metodas siekiant palyginti reikšmingus teisės aktus dėl piramidinės prekių platinimo sistemos uždraudimo. Lyginamosios analizės metodu atskleidžiami tinklinės rinkodaros ir piramidinės prekių platinimo sistemos ypatumai. Apibendrinimo, loginis metodai buvo naudojami formuojant, bei pagrindžiant išvadas. Hipotezė. Tinklinės rinkodaros ir piramidinės prekių platinimo sistemas galima atskirti teisinėmis taisyklėmis – pasitvirtino. Tinklinė rinkodara nėra aiškiai apibrėžta, tačiau, pagal įvairių ekonomistų, mokslininkų priskirtus požymius, galima atskirti tinklinę rinkodarą. Šalyse galioja skirtingi nacionaliniai teisės aktai dėl piramidinių prekių platinimo sistemų. Norint suvienodinti įstatymus dėl nesąžiningos komercinės veiklos buvo priimta Nesąžiningos komercinės veiklos direktyva. Svarbus yra Nesąžiningos komercinės veiklos direktyvos pateiktas ,,juodasis sąrašas“. Šis sąrašas padeda vartotojams atpažinti nesąžiningą paslaugų tiekėjo ar pardavėjo veiklą. Ar įmonė nevykdo prekių platinimo sistemos remiamasi - ,,70 %” taisykle, ,,10 mažmeninės prekybos klientų taisykle“, ,,perpardavimo“ garantija ir kt.
Networking marketing is a type of direct marketing, also known as network marketing and interactive commerce. Network marketing is considered to be an american Carl Reinborgas. America was developed in 7's, while in Europe - 8's. Pyramid distribution system is banned in many countries, but network marketing is legal. However, those two systems have common features and are always confusing. First, companies which use network marketing model, encourage consultants to invite joining the network more people, because their income depends on the assembled group achieved turnover. Therefore, the more people invited, the more receive income to the founder of group. For this system, this trade pattern is confused with pyramid system. Second, the company encourages distributors to purchase not inconsiderable quantity of products. Individuals in the bottom of the pyramid purchase a large quantity of such goods, which are not sold to the public. Most sales take place between those who are inside the pyramid structure or between the new employees. Third, concepts ,,network marketing\" and \"pyramid system\" is not legally defined. There is not find such definition in scientific articles or books, as a network marketing or pyramid system. Objectives of the study - a systematic and analytically to examine the network marketing and pyramid system concept, to reveal what criteria are applied to separate network marketing and pyramid system. The object of investigation - signs unifying and separating the network marketing and pyramid of distribution systems. Relevance - the subject is relatively new – the legal aspect of network marketing and pyramid schemes of distribution, is not widely researched. At Masters work was used document analysis, comparable, summarizing and logical methods. Masters work reveals the network marketing and pyramid system distinguishing criteria between legal rules that apply to these systems by themselves. Generalization, logical methods have been used in formulating and justifying conclusions. Objectives of the study: identify the main network marketing, and pyramid system development; to analyze the network marketing and pyramid in the distribution system of the essence and exclusion; to reveal the unfair commercial insurance reasons; identify a network marketing and the pyramid system of separation criteria. Network Marketing is also based on new members into the product distribution system. Direct sellers earn most of their vendors creates a network that reaches a high turnover. It is progressive, and normal activity pattern, which is recognized around the world. It should be noted that the pyramidal system of prohibition of the distribution is important for consumer protection, effective and fair competition. The hypothesis of the thesis- network marketing and pyramid distribution system can distinguish legal rules – confirmed. Network Marketing is not clearly defined, but, according to various economists, scientists assigned to the characteristics of network marketing can be distinguished. Different countries have national legislation on the pyramid of distribution systems. In order to harmonize the laws on unfair commercial practices have been adopted by the Unfair Commercial Practices Directive. What is important is the Unfair Commercial Practices Directive, a blacklist. This list helps consumers identify fraudulent service provider or vendor performance. Pyramid system main features - the recruit of new participants, as well as the realization of promised sales. The difference in the distribution of the pyramidal system and network marketing is that the pyramidal system, the distribution is not the resale of warranty, you can not return unsold merchandise. The similarities between these systems is the admission of new participants, and support structure. Commission structure and marketing plan must be clear and detailed. Network marketing companies are responsible for products which are provided with the distributors, as well as the compensation plans and the motivation of the sale of the company distributed products. Correct information includes not only wages but also the information about the same job. Does the company fails to comply with the distribution system based on - ,,70% rule“, ,,10 retail customer rule“, ,,resale“ security and others.
