German Federal Supreme Court, Judgment of 30 April 2020, I ZR 228/15 – ‘Reformistischer Aufbruch II’ Following the preliminary ruling of the Court of Justice of the European Union (CJEU) in Spiegel Online GmbH v Volker Beck, Case C-516/17, EU:C:2019:625, the German Federal Supreme Court (BGH), which had referred the case, found that the unauthorized publication—on an online news portal—of full versions of a previously published essay written by a politician did not infringe his copyright in said work.
