CJEU, Pelham and Others v Hütter and Others, Case C-476/17, EU:C:2019:624, 29 July 2019. The reproduction of small samples does not infringe the right of phonogram producers under Article 2(c) of Directive 2001/29 if the sample is modified and cannot be recognized. Longer and recognizable samples can only benefit from the quotation exception if they—inter alia—enter into a ‘dialogue’ with the original work.
