The US Supreme Court’s ruling in Andy Warhol Foundation v Goldsmith, it was hoped, would provide clearer guidelines on the application of the US fair use defence to transformative works. Whilst these hopes were not fulfilled, the ruling provides an opportunity to reflect, from a European perspective, on the fetish-like obsession with fair use. More concretely, the ruling highlights the benefits for legal certainty of purpose-bound exception to copyrights exclusive rights and underlines the importance of a systematic development of copyright norms.
