Abstract (en)
The concept of diminished responsibility was first introduced in Lithuania in 2000 with the enactment of the new Criminal Code. As diminished responsibility was considered to be a constituent of murder/severe health impairment caused in a state of passion (Articles 130, 136 of the CC), the problem arose of the relationship between diminished responsibility (Article 18) and aforementioned crimes. In view of this fact andwith the focus on regulation in foreign countries, the relevant scientific research, and the most relevant case law, this study aims to reveal the relationship between the above-mentioned areas.
