Abstract: Šiame darbe atskleidžiamas asmenų lygiateisiškumo principo taikymas, siekiant įvertinti, ar nepažeidžiamos vietinių Lietuvos ir užsienio piliečių įdarbinimo sąlygos. Kiekvienam dirbančiam asmeniui svarbus jo, kaip darbuotojo, lygių galimybių užtikrinimas ir teisių pripažinimas. Įstatymai rašo: „asmens laisvė pasirinkti darbą ar verslą negali būti varžoma dėl lyties ir seksualinės orientacijos, rasės, tautybės, kalbos, kilmės, pilietybės ir socialinės padėties, tikėjimo, santuokinės ir šeimos padėties, amžiaus, įsitikinimų ar pažiūrų, priklausomybės politinėms partijoms ar visuomeninėms organizacijoms, aplinkybių, nesusijusių su darbuotojų dalykinėmis savybėmis.“ Lygiateisiškumas dar kitaip vadinamas nediskriminavimo principu. Įvairių organizacijų atliktų tyrimų rezultatai, bei kitos Europos Sąjungos vykdomos apklausos rodo diskriminavimo problemą norinčių įsidarbinti Lietuvos ribose atžvilgiu. Šiame darbe analizuojamos diskriminavimo principo nukrypimo priežastys. Būtina pažymėti, kad teisės aiškinime principai atlieka svarbią reikšmę. Bendro pobūdžio idėjos, išreiškiančios visuomenės vertybes, padeda palaikyti teisės normų taikymo stabilumą. Pačiais reikšmingiausiais darbo teisėje laikomi lygiateisiškumo ir nediskriminavimo principai. „Reikėtų atkreipti dėmesį į tokią aplinkybę: bet kokį įstatymą, ar kitą teisės aktą galima įvertinti per asmenų lygybės principo prizmę, bet koks teisinis tekstas gali būti „perskaitytas“ šiuo aspektu.“ Kadangi darbuotojai laikomi labai reikšminga sistema visos pasaulinės sistemos atžvilgiu, tarp jų turi būti garantuojama lygybė prieš įstatymą, o bent menkiausias nuokrypis laikomas pažeidimu. Darbe vertinama, ar visais atvejais laikomasi lygiateisiškumo principo įdarbinant tiek vietinius, tiek užsienio piliečius Lietuvos Respublikoje ir kokie atvejai neapima to pažeidimo, o nustato proporcingumo pusiausvyrą vardan saugumo užtikrinimo valstybės viduje.
In order to assess whether the employment of Lithuanian and foreign citizens in Lithuania does not violate the principle of equality, this paper deals with the detail overview of this principle’s practical and theoretical application, as well as of the problematic aspects of employment, such as discrimination. It should be noted that the principles has an important meaning in the judicial interpretation. General ideas expressing the values of society help to maintain the stability of the national legislation application. The principles of the equality of rights and non-discrimination are the most significant in the labor law. It is necessary to pay attention on the following fact: any law or other legal act can be assessed through the prism of the principle of equality of persons, any legal text can be" read "in this aspect. The law proclaims that personal freedom to choose the work or business can not be restricted due to the sex and sexual orientation, race, nationality, language, origin, citizenship and social status, religion, marital and family status, age, opinions or views, cooperation with the political party or public organizations, the factors that are not related to the employee's professional qualities. Since the old times the work has been considered the main source of the social human existence. In the process of globalization after the Second World War, in order to maintain the cooperation with the international organizations, there was a rapid economical development among foreign countries, on which ground international agreements appeared and the employees got more rights, the possibilities of taking root in another country were simplified. The need to improve their own and their family’s life encouraged to look for the better financial opportunities outside their home country. According to the foreign case law it is considered that the foreign citizens are more vulnerable in the labor relations, so they are especially protected by international agreements. The protection burden of the Lithuanian citizens in the labor law area goes to the Member State where the national law is applicable, but the question is how much the local protection is fully effective to provide all the guarantees to its citizens. The analysis of data of the surveys conducted by the European Union and other organizations allow us to see the problem of dominant discrimination in the Lithuanian labor market sphere. Since employees are considered a very important system in the respect of entire global system, there should be guaranteed equality against the law between them, and even the lowest deviation is considered violation Summarizing the paper it is concluded that the additional restrictions on the employment of the foreigners in Lithuania imposed by the state compared with local citizens do not violate to the principle of equality, but the assessment of the study data help to see common discrimination of the citizens on the various grounds that allow to state that the principle of equality is violated only partially. The aim of the paper: to answer the main question whether the employment of Lithuanian and foreign citizens in Lithuania does not violate the principle of equality. To achieve the aim of the paper the following tasks are set: 1. To analyze the principle of equal rights and the content of the principles with the same meaning in the labour relations. 2. To determine the effective implementation of the principles in labour relations employing local and foreign citizens in Lithuania. 3. To present the specificity of legal regulation of the work of European Union and third countries foreign citizens and assess whether the national legal restrictions do not violate personal rights freely to choose desired work.
