Abstract
Bakalauro baigiamajame darbe nagrinėjamas hipnozės pripažinimas baudžiamojoje teisėje ir aptariami du pagrindiniai aspektai, kurie sieja hipnozę ir baudžiamąją teisę – 1) hipnozė, kaip metodas sugrąžinti prisiminimus, užslėptą informaciją, kuri padėtų išaiškinti nusikaltamą veiką, ir 2) hipnozė, kaip nusikaltimo padarymo būdas – konkrečiai nagrinėjamos fizinio ir psichinio smurto sąvokos, jas siejant su hipnoze. Aptariant pirmąjį aspektą pažymėtina, kad hipnozės metodas buvo ir vis dar yra naudojamas kai kurių JAV valstijų baudžiamosios teisės srityje, todėl nagrinėjama ar hipnozė galėtų būti leistina ir taikoma Lietuvos teisinėje sistemoje, ar tai būtų naudingas metodas sklandesniam nusikalstamos veikos tyrimo įgyvendinimui. Aptariant antrąjį aspektą, hipnozė gali būti panaudojama nusikalstamų veikų atlikimui, todėl nagrinėjama kaip tiksliai teismai turėtų įvardinti šį nusikalstamos veikos atlikimo būdą – kaip fizinį ar psichinį smurtą, kad būtų pasiekta vienoda teismų praktika šiuo klausimu. Esant skirtingoms mokslininkų nuomonėms bei teisiniam vertinimui, hipnozės pripažinimas baudžiamojoje teisėje tampa probleminiu klausimu, kurį būtina analizuoti ir išsamiai nagrinėti.
This bachelor thesis will analyze whether hypnosis can be recognized in criminal law. The analysis of this topic raises two aspects of research: 1) hypnosis as a method to recall memories, extract the necessary information hidden in a person's mind to help clarify a crime and contribute to justice, and 2) hypnosis as a way to commit a crime. Regarding the first aspect, it should be noted that the hypnosis method has been and still is used in the field of criminal law in some US states, but scholars differ widely on this issue, debatable reliability of hypnosis, there are many disagreements on the use of hypnosis results as evidence in court. This raises the question of whether hypnosis could be allowed and applied in the Lithuanian legal system, or whether it would be a useful method for a smoother implementation of criminal investigation. In discussing the second aspect, hypnosis is viewed from the other side - it is used to commit a crime, and as hypnosis becomes a way of committing a crime, it is necessary to decide what the specific method is - physical or mental violence. The problem is that scholars also disagree on this aspect, interpret the concepts differently, and the question arises if in Lithuania hypnosis would be used to commit a crime, how exactly should the court name this method in order to achieve uniform case law on this issue.
Relevance of the topic – the idea of applying hypnosis in criminal law was raised in the second half of the 20th century and was most widespread in the USA. However, the different results, the divergent expert opinions, did not lead to a uniform case law and did not lead to a general and definitive conclusion on the recognition of hypnosis. Some U.S. courts have recognized the use of hypnosis to detect criminal activity, while others have radically banned the use of hypnosis, arguing that it is an absolutely unreliable process for extracting information. Studies were conducted with people who gave different results and thus formed different opinions and positions on the issue. The author Martin T. Orne analyzed the pros and cons of hypnosis and concluded that the application of hypnosis is possible under special conditions, but still the results obtained cannot be accepted as absolutely correct. So the doubt on this issue remains and so far this topic has not been fully analyzed. It is also the case with the treatment of hypnosis, where it is used to commit criminal acts against another person. Researchers disagree on how to classify hypnosis, interpret specific concepts of the method differently, and make contradictory arguments, for example, O. Fedosiuk argues that hypnosis is a form of physical violence, and L.V. Serdiuk is a form of expression of mental abuse. As both aspects of the research are debatable, the evaluations are different, this topic needs to be analyzed and this proves the novelty and relevance of the topic.
