Abstract
Teisininko profesija yra ypač svarbi ir reikšminga teisinėje valstybėje, kuomet teisininkas savo kompetencija bei nepriekaištinga reputacija padeda užtikrinti pagrindines teisines vertybes - teisės viešpatavimą, teisingumą, asmens teises ir laisves, teisę į teisingą teismą, teisinę pagalbą ir kt. Įstatymai numato, kad asmuo, norintis tapti teisinės profesijos atstovu, privalo būti nepriekaištingos reputacijos, o pradedant vykdyti savo tiesiogines funkcijas prisiekia vykdyti jas dorai bei sąžiningai. Tai reiškia, kad teisininkams taikomi griežtesni, nei kitų profesijų atstovams, atitikimo profesijai reikalavimai. Šiuo metu Lietuvoje egzistuoja eilė teisinių profesijų, kurių atliekamos funkcijos yra gyvybiškai svarbios, užtikrinant teisinės sistemos veiklą. Teisininko profesija apjungia plataus spektro teisės profesionalus, kuriems taikomi aukšti, tiek kompetencijos, tiek moralaus elgesio, reikalavimai. Šie reikalavimai kiekvienai teisinei profesijai sukuria savitas etiško elgesio taisykles, kurios yra įtvirtinamos etikos kodeksuose. Tuo pačiu sukuriami skirtingų teisinių profesijų etikos standartai, kurie yra deklaruojami visuomenei. Tačiau ar visų teisinių profesijų etikos standartai yra vienodi ir nuo ko jie priklauso? Kas lemia jų vienodumą ar skirtumą? Darbe buvo keliama hipotezė, jog teisininko etikos standartas skirtingoms teisinėms profesijoms Lietuvoje nėra vienodas. Šiam tikslui buvo parinktos trys teisinės profesijos: advokato, teisėjo bei notaro. Prieita prie išvados, advokato lojalumas klientui, teisėjo nešališkumas bei nepriklausomumas, notaro korektiškumas kliento atžvilgiu ir valstybės kontrolė jam, t.y. tai, kas sudaro šių teisinių profesijų specifiką, lemia tai, kad pagal teisininko įsipareigojimus atstovaujamam subjektui, teisinių bei moralinių įsipareigojimų turinys yra skirtingas, todėl teisininko etikos standartas šiuo aspektu yra nevienodas. Tačiau visų kitų, šiame darbe nagrinėtų teisininkų, teisiniai bei moraliniai įsipareigojimai yra panašus: • Bendravimas su institucijomis bei asmenimis, su kuriais susiduriama atliekant teisininko funkcijas, grindžiamas pagarba; • Kiekvienas iš nagrinėtų teisininkų savo profesijai įsipareigoja dorai ir sąžiningai vykdyti pareigas, saugoti teisininko vardą bei savo profesijos garbę, tarpusavio santykius grindžia solidarumu, taip pat yra geranoriškas bei paklusnus bendradarbiaujant su savivaldos organais; • Visuomenei kiekvienas teisininkas įsipareigoja tinkamai vykdyti jam priskirtas teisines funkcijas, stiprinti profesijos pasitikėjimą savo profesija visuomenės akyse. Todėl šiai aspektais teisininko etikos standartas yra vienodas. Taigi darbe keliama hipotezė pasitvirtino iš dalies.
Legal profession is especially important and significant in legal system of each country. Lawyer’s qualification and impeccable reputation helps to maintain main legal values – the rule of law, justice, individual rights and freedoms, right to a fair trial, legal help etc. According to legal acts, a person who is becoming a representative of legal profession has to have impeccable reputation, and before starting his legal activities gives an oath to take it fairly and honestly. It means that higher standards of requirements of becoming a professional are applied for lawyer, than for other professions. There exist many legal professions nowadays in Lithuania. Their functions are extremely important in providing and maintaining legal system. But legal profession unifies a wide spectrum of legal professionals, to whom requirements of high level competence and moral behavior are applied. These requirements create special rules of behavior for each legal profession. Same time the ethical standards of different legal professions are created and declared for the society. But are they equal and what they are depending on? Or should they be equal? We will try to find out, because professional legal ethics is a key aspect in lawyer’s legal activity. The goal, hypothesis and tasks of the thesis The goal of this thesis is to answer a main question: Is the lawyer’s ethical standard equal for different legal professions in Lithuania? The hypothesis of the thesis is that the lawyer’s ethical standard for different legal professions is not equal. To achieve the goal of the thesis, to prove or deny the hypothesis, following tasks are raised: 1. To describe the conception of modern lawyer’s professional ethics; 2. To analyze the ways how lawyer’s professional ethics can be ensured; 3. To define conception of lawyer’s ethical standard; 4. By using defined conception of lawyer’s ethical standard, to analyze contents of legal and molar obligations for different law professions in Lithuania: After accomplishing the tasks, conclusions were made: 1) Modern legal ethics is the lawyer’s activity rule of his practical life, his expression of public and internal image, which in a particular society, in particular period of time is influenced by certain political, economical, social and other trends. Globalization and integration processes are one of these trends. 2) Legal rule is not always capable to ensure high lawyer‘s ethical standards. That‘s why this field is regulated by help of ethical codes, which are the sets of professional ethical rules establishing ethical standards of obligations to entity, legal system, profession and society. Infringements of ethical standards can cause disciplinary actions by examining it in Courts of Honor. 3) Lawyer‘s ethical standard was determined as lawyer’s legal and moral obligations owing to: • entity, whose interests representing; • institutions and individuals, encountered in the lawyer’s legal functions; • profession; • society. 4) Advocate‘s loyalty to the client, judge‘s impartiality and neutrality, notary‘s loyalty to state and objective help to the client, it all creates particularity of these legal professions. It means that the contents of legal and moral obligations differ, so lawyer’s ethical standard is not equal in this part. But regarding other three aspects of defined ethical standard, contents of moral and legal obligations are similar: • Communication with institutions and individuals in professional lawyer life based on respect to them. • Each lawyer obligates to his profession to take his legal activity fairly and honestly, to preserve and respect lawyers name and his profession; relations between colleges are based on solidarity; goodwill and compliance are the main aspects in relations with institutions of professional autonomy. • Content of legal and moral obligations owed to society is based on trust to lawyer and he should preserve it. Regarding these three aspect, lawyer’s ethical standard is equal. So, the hypothesis of the thesis was proved in part. advocate, judge and notary.
