Abstract
Darbe remiantis teisės doktrina ir teismų praktika suformuluotos pagrindinės notaro kaltės kaip civilinės atsakomybės sąlygos tezės, pateiktos teismų praktikoje dažniausiai kylančios kaltės kaip notaro civilinės atsakomybės sąlygos taikymo problemos, pasiūlyti šių problemų sprendimo būdai ir atitinkamai teisės aktų pakeitimai ir papildymai. Atskleistas notaro socialinės-teisinės padėties ypatingumas, kuris sąlygoja notaro kaltės kaip civilinės atsakomybės sąlygos specifiką,įvertintas kaltės kaip notaro civilinės atsakomybės sąlygos teisinis reglamentavimas ir praktinis taikymas analizuojant Lietuvos Respublikos teismų praktiką; apžvelgta notaro kaltės samprata užsienio valstybėse.
The main aim of this article is to distinguish the features of notary‘s fault, to show it as an essential condition of notary‘s civil liability. To achieve the aim, the civil law doctrine is taken as a basis for studying the court practice and aftewards conclusions are presented. Notaries as professionals face higher risks of causing damage to third parties while conducting their professional services. That‘s why notaries are subject to higher attention and accurancy standarts, strict and full liability. Fault is an essential condition of notary‘s civil liability. A notary becomes civily liable when four major conditions are present: damage, illegal action, causality and fault. The illegal action is not the same as notary‘s fault. There is a presumtion to disscuss notary‘s fault if the contract is invalidated by court. The lowest negligence, innatention, inacurancy and like determine notary‘s fault. Notary must be not only high qualified lawyer, but also thoughtful and attentive lawyer to the extent notary would mind all circumstances occuring upon conclusions of a contract and if there is a slightest doubt, notary should endeavor to disclose the truth. When considering notary‘s fault it is very important to consider other solidary liable persons. The compensation of damage under civili insurance is possible even if tortious liability is not applicable
