Abstract
Garsus JAV rašytojas Stan Lee yra pasakęs, jog „kartu su didelėmis galiomis taip pat kyla ir didžiulė atsakomybė“. Šis teiginys, dabar yra vienas iš teisės principų, reiškiantis tai, kad „kartu su teisėmis turi būti perimtas ir analogiškas atsakomybės standartas“. Analizuojant bankrutuojančio juridinio asmens kreditorių procesinį statusą, galias bei atsižvelgiant į Lietuvos Respublikos jurisprudencijoje esantį kreditorių teisinį reglamentavimą, kyla pagrįstų abejonių ar minėtas principas atitinka ir bankroto procese esamą kreditorių padėtį. Siekiant išaiškinti kreditorių atsakomybės atsiradimo priežastis bei sąlygas, šiame darbe analizuojamas bankrutuojančio juridinio asmens kreditorių atsakomybės taikymo klausimas dėl jų nepagrįstų, žalą sukeliančių sprendimų priėmimo. Nagrinėjamos juridinių asmenų bankroto bylos, mokslinė literatūra, taikytas įstatymo analogijos institutas, lyginamas kreditorių bei akcininkų statusas bei galių santykis.
The famous American writer S. Lee said that „with great power there must also come - great responsibility“. This statement is now one of the principles of law, which means that “along with rights a similar standard of liability must be taken”. However, according to the jurisprudence of the Republic of Lithuania, it is not clear whether this principle can be applied to creditors in bankruptcy proceedings. The issue of the bankruptcy creditors' legal liability has yet not reached the attention of legal theorists and comprehensive case-law interpretation. This work is an initiation defining the potential liability of creditors in bankruptcy proceedings. This paper analyzes the legal liability of bankruptcy creditors' illegal, unjustified and damage causing decision-making. In order to clarify the bankruptcy creditors' legal liability reasons and conditions of application, this paper analyzes the insolvency proceedings of the legal entities, application of law analogies, as well as the comparison of the creditors and shareholders status including powers and rights ratio.
